Ok my bro has been driving my old car and still registered to my name. The intersedtion is at 34Ave and 91 St, a camera seats there pointing towards the south. Here's the story, on this intersection there is a lane were you can merge right going towards west to 34th ave. Now this exit was blocked due to a construction, so early in the morning my bro decided to take a right turn from the main intersection since he can't do through the right lane exit since it was blocked. Now he got a red light ticket because he took a right turn and he told me he stopped first for like 5 seconds or so because the stop light has been activated for 11.8 seconds. He could have waited before he turned but you know what they teach us, you can make a right turn as long as it is clear and I don't think he knew that there was a camera there.
Now does he have a case? I know it's stupid that he is getting a ticket because the merge lane was under construction. And one more question since the car is registered under my name, do I have to go to court or can my bro take my place since he was the diver? Any help from the cops around here will be much appreciated. |

since you are the owner of the vehicle, it is your responsibility...
If he did stop for 5 seconds as he claims then you can fight the ticket, since there was a merge lane the camera was probably set up to take all traffic that crosses the line.
Make darn sure he stopped though otherwise no such luck. |

Here's the deal ... the first Court appearance anyone can show up as long as they answer to the charge for you. If you plead not guilty though I would suggest that at the Trial both you & your brother should show up. You may want to take photos of the construction site (if still there) or get a record of the fact that construction was occurring that date & time from the City. You may also want to get something stating the sequence of the camera & whether or not it actually takes a picture of anyone going through the red even if turning, from the City as well.
Here's something to think about though ... if your brother shows up & says that he was driving then the ticket can be amended to a straight red light charge in his name instead of an RO charge (this means demerit points on his licence if found guilty plus the $287). If he pays the fine for you then there's no demerit points & the only one that suffers is him for the $287 (doesn't affect your insurance either way). I guess you really have to decide how much you trust what your brother is telling you. If it was early in the morning (probably slim to nil for traffic) why would he wait for 5 seconds knowing that he is going to turn. Just something to think about.

I should have when i got one a year ago, i also was turning
right on a red light which i stopped for, just not long enough i guess
and still got a ticket!
now if you still have the ticket, take a look at it,
there are numbers at the top of the picture,
they show the date, they also show how long you stopped for.
the edmonton police service says that a full stop is like 3 or 5 seconds,
look see how long you stopped for, if you stopped for the required time great!
if not i still think it should be thrown out of court,
I have looked in the drivers manual that the alberta Gov. hands out to
study before you go for your license and it doesn't say anywhere in there
about having to stop for 3 or 5 seconds!
I am a few years old now and when i wrote my test to get my license they
said the definition of a full stop was just that a full stop where the wheels
came to a full stop, I am sure that i can come to a full stop in a second or so.
As far as i am concerned red light cameras that are getting people turning
right at a red light are nothing more than a CASH COW!!!!!!!!!!!!!!!!!!!!!
talking about cash cows just don't get me started on section 61(1)
and 61(2) of the traffic safety act!
vague laws are just a opportunity for law informant to abuse their power.

The noise part is a little vague don't you think? there should be a dB level.
and
61(2) drive/operate MV if exhaust outlet of muffler widened.
key words here would have to be exhaust outlet of muffler, i know
people who have been getting tickets in edmonton for mufflers with
large openings, the muffler opening has not been widened they are just bigger,
with a bigger tip.
I feel these tickets are a cash cow.
now don't get me wrong there are lots of kids out there who are running
what i call fart cans that are very loud and annoying and should be ticketed
under:
61(1) but not both 61(1) and 61(2).
more people need to fight these tickets, and i am sure with the new fine
amounts this will be the case.
