I don't know but its a good way to get a knife in your throat :rolleyes:

It would probably be hard to get convicted, even if you get charged it pretty bogus and the CP would probably just drop them.

in ortherwords, even pretending to throw something at someone but you dont, but they honestly believed you were going to and were capable of it, then that is an assault...
so yes, spraying something is using an indirect method of application of force without their consent and they believe they are in harms way in any way...
HOWever... if said person was tresspassing (and was not a child), and you warned them you were going to do it if they did not leave, then that would likely be another story and you would be probably be fine...

assault is weird - much aside from its counterpart 'battery' which does require force and not just the apprehension of harmful force without any actual contact being required...


... but that's just my thought on it... I highly doubt you'd ever be charged for assault for spraying someone with a hose, in the real world... too much hassel for absolutely nothing for the police to charge as well as to go to court over something so petty...
theoretically speaking, though, yes... real world - not worth the time... gotta love the law :thumbup:

Long story involving me and my neighbor across the street. Last weekend he saw fit to stroll into my garage and start lectuing my wife about something she had absolutely nothing to do with. I got in his face and told him to GTFO my property NOW. But I probably should have just ambushed him with the hose when he wasn't expecting it. :lol:

Actually the look on his face WAS pretty funny. We were both in the garage at the time but I don't think he saw me because I had the hood up on the car. He likes to seize the opportunity to bitch at my wife when nobody else is around because she's a pushover. I'm surprised I didn't give the shrivelled old fucker a heart attack.

Close the garage door, lock the main door with him inside and call the cops. Tell them someone has broken into your garage. :lol:

if someone did that to me or my woman, not only would i spray them with the hose, i would strangle his ass and sacrafice my baseball bat across his head. then i would tell him to stay off my property :mad: but thats just me lol

For a verbal lecture? I think the hose sounds pretty suitable here, if you did what you said, then Im pretty sure you would be charged with assault. Next time nerf gun him.

I don't think I'd deal very well with some guy getting himself into an enclosed space when he thinks my woman is alone.

I forget the movie, but the conversation might very well go something like this:

Me "You need to leave right now."

Him "I have a blah blah blah..."

While shutting the garage door, "OK..." picks up handy breaker bar... "Now you CAN'T leave."



You know what, the more I think about this, fuck you worrying about getting charged with assault, think about talking to the police about him trespassing and threatening your wife. That shit is TOTALLY not acceptable in my books. If this is what he pulls when he thinks you aren't around, what's he going to do when you really aren't there???

Well, yeah, but that's kinda the point. Up until now he was able to be cowardly and avoid me altogether. This time, I think I made a lasting impression. :thumbup:

Anways, he's just a decrepit old man with a limp. Probably in his late sixties.

I think you wouldn't have any problems with the cops if you told them the story.

Cops: Why is this man all bloody and lying on the ground of your garage?
You: He walked into my garage and started to verbally intimidate my wife
Cops: Really?
You: I told him to leave and he made a threatening motion toward my wife and I defended her
Cops: Okay, thanks bye.

It's your property and as far as I am aware of, you are allowed to defend it. If we were in the states you could have pulled a gun on him and convinced him to leave a lot faster.

Unfortunately this is not true. You are not allowed to defend your property with deadly force... only to defend what you do in court under proof of threat of physical harm (knife, gun, bad breath). An old man locked in your garage being sprayed by a water hose would probably be okay (and good for some pictures), but a fit 25yr old male beating the shit out of an old man with a pry-bar would probably not go over well. However, the Mrs. might have a little more leeway ;p

Or you could lock him in and verbally intimidate him back. Then call the police ;p Ganking him in your own place is not advisable.
