Going to work today at roughly 2:35pm, I was hit by an 07 bmw 323i turning left. I was following another car, I saw the bmw pulling out to make the left, stop for the car in front of me, and when I was 50m from the intersection he takes off... I don't think the guy even touched the breaks; hit me square on my passenger wheel.
I was going 50-60km/hr at the time, he was doing <20km/hr and I cut as close to the center divider that I could before we touched. His bumper is missing a 8"x4" piece of paint on the passenger side (scratched really deep into the plastic... from my spokes), my car has a couple scratches on the wheel (will probably buff out) and black smudge on my bumper cover (also should buff out) and a 2" crack in my side skirt also on my passenger side. Really not that bad for damages given the speeds, I expected my 1/4 panel to be pushed in a foot...
I come to a stop down the road, we both get out of our car. He started coming over to me, leaving his car in the middle of the road, I tell him to go into a church parking lot across the street. The lady in a van which was at the stop sign behind the guy is a real bitch and drives around him and takes off (didn't get her plate). I back up the 15m and pull into the church parking lot as well.
We get there and park, I get out he is already inspecting damages to his car. I get out of my car flustered, but not aggressive or mad or anything. He's pretty mellow as well (had he came out screaming I would have buffed out the damage with his face :lol: )
Him: "Didn't even see you, did we even touch"
Me: "uh ya, we did" (point to his bumper)
Him: "wow, I didn't even see you, you came from no where" (it was raining quite hard but I don't drive a small car...).... "I don't know if we touched..."
We go over to my car (at this point I haven't seen anything yet and am expecting some damage), all we find is a bunch of his paint on my wheel and a crack in my sideskirt (its not shitty fiberglass, its oem plastic rocker molding).
He keeps pointing out that it isn't that bad. I tell him we better exchange info, his pen doesn't work so we go into the school/church, go to the office and exchange info. I checked the name on his DL but didn't even think to get his DL down, I do have all his insurance and plate # though.
Fuck this is a boring read but here is my question.
I didn't get him to sign anything claiming fault, I have no witnesses (thanks to the bitch who took off) and damages that look like this occurred in a parking lot (his bumper looks like he scratched against a concrete wall or something). I'm going to the police station tomorrow but what course of action do I have if he denies hitting me, or claims that it was in a parking lot (50:50) or some shit? Basically at this point its my word against his... If he decides to pull some shit there is fuck all I can do rather than show up at his house one day and have a talk with him... It definitely doesn't help that I'm still a young driver (but no accidents or tickets)
I'm going to get a quote tomorrow before school but I have a feeling that this guy is going to shit a brick and blow me off. The way he talked about the crack implied that I was lying and the crack was already there... I'm sure that a new rocker molding /w paint will be >$350 and to the average person they will think I'm trying to milk this guy... I don't have collision by the way, just pd/pl, I'm going to give the guy the option of going outside insurance, and just go through insurance if any trouble arises :dunno: |

I also forgot to get his home phone number. I know part of his address (it is just outside Sherwood Park). How can I find his phone number?

i had a lady side-swipe me a couple months back
gave me all her info
but i didn't have a phone number for her (the one she provided was fake)
so i punched in her address (off her pink card) into the website and lucky for me - it returned a home phone number associated with that address
and it was all correct info!
being the first person to file a police report also helps
and being the first to get estimates done |

if you think there is more then 1000$ damage, go the the police station ASAP, like now! file a report and make sure you have the address, time everything in the report. state exactly what happened and you will be good to go.
some fuck head rear ended me and i had no collision so i had to call his insurance and bitch at them till i got what i wanted.
this is all assuming he doesnt want to pay cash. tell him he has so many hrs to come up with the money.
you should be filing a report though if its through insurance. he needs to tell you asap. but if its over 1000$ file a police report regardless.
he is suppose to go in and file one too, but you should be the first one to file, hopefully. |

Tried canada411 already, didn't turn up anything that matched the address I remember (didn't write the address down, just glanced as I wrote down other information)
All I remember for address was "heritage xxxx range road xxx". If I can't find it then tomorrow I will be phoning up half of edmonton (somewhat common last name sucks balls). This is my first time exchanging information so I didn't really know what to get, I wrote everything off his insurance card and took his plate... The address might not be current?
I might end up trying phoning up his insurance but I don't know if they will give me his contact info....
The conversation would probably go like:
"why would you like Mr. X's phone number"
"oh no reason... I just want to talk"

"oh, you dirty fucking whore!"
I have his VIN would a service similar to carfax turn up house addresses?
Blackout-spec: His vehicle being a 2007 it definitely is over $1000. Its only cosmetic damage to both vehicles but paint isn't cheap...
I would have taken the other guy a police station with me but I had to get to work and I wasn't really thinking straight (in hindsight I should have got him to sign something accepting fault and then took him to make a report). I will be doing it first thing tomorrow morning before school. |

| you dont need to take him with you to the police station, leave that up to him if he wants to go or not. just make sure you file a report, and if he tried to fuck you over by giving you false info, just call his insurance and say you were hit by so and so and you want it fixed! |

Report the info you got to the police... If you have the Licence plate (asuming it is reg. to him) they will call him and require him to provide a statement...
As police didn't attend the scene it is unlikely he will be charged, however make sure you not damages to your vehicle and his in your statement so the insurance companies can fight about it for a couple of years

The only reason I would want to go down with him is assurance that he wouldn't make up some BS story. I have a feeling that he didn't go to the station, he was pretty nonchalant about the whole thing.
I don't know if it's just my preconceived view of BMW drivers or the guy himself but I'm feeling that he is a little shady. He was very professional but I didn't like the way he talked.
Blocker: I'm hoping that this doesn't go through insurance, I don't need that shit right now. I also don't really care about him getting charged, we all make mistakes w/e, as long as my car gets fixed to previous condition I couldn't care less if he gets no other repercussions.
If the other guy has already filled a report would the officer give me his contact number when I fill out mine? |

Thats great! I'm sure that he didn't get my phone number either, its not on my insurance info.

I wouldn't stress about it.
As suggested, fill out your police report and be as accurate as possible. I'm not an insurance adjustor, however I think it's safe to say that when two stories are completely different they can usually tell which is true from the damage present and the report itself. |

I went to the Sherwood Park RCMP station yesterday over lunch. Took 10x longer than I thought it would...
The bmw owner hasn't filled a report yet, but even just the paint damaged caused is over $1000. If I want to get bitchy there are spider webs and paint transfer all over my rear bumper cover and it is misaligned; I would be happy with just a new rocker molding :) I was pretty chilled right after he hit me so he might think I just don't give a shit? The police will give me an accident report once he comes in. Anyone know how long he has to write his statement?
I'm going to be parking my car and pulling insurance (keeping fire + theft) next week, will that cause any issues? I haven't got any quotes yet but I shouldn't need to bring my car to get one... |

| Hate to break it to you, but something similar happened to a friend. His insurance company contacted the other one, and of course they denied it. They went 50/50 on liability and both parties had their insurance jacked double. All this over less than 1000 damage. INGsurance sucks. |

Pretty much the only thing going for me is that the damage is on my left rear, and his is on the right 1/2 of his bumper. My problem is that we just skimmed each other, there is no solid damage. Once I wash off paint transfer its going to look like someone just kicked my rocker molding. I'm going to take some pictures today then buff everything out. |

Well a bit of an update:
I got quotes ranging from $500 to $300. Phoned the guy and told him the quotes and said I didn't need anything done soon; he said he would cover it once he sees the quotes... this was like 2 weeks ago. Since then I've decided to make the car my dedicated winter car, the molding wasn't in mint shape to begin with. The entire time I was aiming for more of the moral standpoint than the economic, and I don't really want my car going in the shop (I know how little driving skill the lot boys have and I don't want them grinding my $2k transmission). I'm going to phone him up this week and tell him that he can keep his money as long as he watches his left turns :dunno: |

I have been in one collision with out a wittness. It was a case with mr Road rager ramming my car and then him taking off. After I pursued and chased him down a few lights later....
Long story short, he accused me of everything under the sun, including being racist. He also tried to intimidate, and turn the story around on me, that I hit him and I ran. I told him to go fuck a hat.
Anyways,
Recieved a call from my insurance co, they processed the claim and let them take care of it. Insurance assigned it a 50/50 as he came into my lane, side swiped me, but they could not prove I did not go into his lane.
So I would would get something in writting if he is going to pay for damages. Also take pics before and after of what your ride is like.
Remember, stick to your guns. |

At first I found the guy to be real sketchy, but that was probably just how he acts when he is stressing balls (ex. right after he crashes into some guy). I was scared that this thing would get turned around on me because I am a young driver (was 17 at the time of accident). I was going to absolutely rape the guy if he started to bullshit but he didn't. He kept things professional and in reality a cracked sideskirt won't hurt the resale value of my car (its a minor flaw, most people wouldn't notice it anyways and realistically my car is only worth ~$9k to begin with). At this point I would rather just let it slide than take my car to shop, then get it repainted, then find out that they can't colourmatch worth shit and that my brand new clutch is now skipping because some retarded lot boy doesn't know how to drive... for the $50-150 it will hurt my resale value I can't care less. I will take it off (the side skirt), use some epoxy and touch up paint and it won't even be visible if you don't know where to look.
Had this been a mint car, then fuck ya he would be paying... but its not so w/e :dunno:
I'm taking it as a life lesson, if you are in an accident, either gather up witnesses or phone the police to the scene regardless of damages. |
