On December 24th, 2007 I was pulled over for no registration. Yeah, I know, I fumbled it. Long story short we also found my insurance company wasn't keeping up with my insurance because according to the police my vehicle was not insured. So, although they were going to let me off on the registration, they impounded my car and had me pay both fines. Because of that, my license plate was confiscated.

Fast forward to May 2008, and I receive a Photo radar in the mail with that license plate number on it. To make it clear that it could not have been me driving, I'll post a couple of facts:

1) I do not own a late 90's Dodge Caravan or know anyone that owns one.

2) My only reason to drive the Yellowhead is for work purposes, in a work vehicle (which is not a Dodge Caravan)

3) My license has been suspended since March 27th, 2008

Now, I go to get my license back on June 28th, I need to pay a $50.00 reinstatement fee and any unpaid tickets correct? So do I have to speak with the Crown Prosecutor to erase this ticket before then, or am I pretty much done for and might as well pay it? I have no problem with paying for tickets that I rightfully deserved, and I'm the first to admit when it's my fault. But when I haven't driven in three months, paying this type of charge is pretty upsetting.

Second question:

It said at the time of suspension I needed to hand in my drivers license. As luck would have it, I misplaced it two days before the suspension, and never bothered making a follow up call to clarify that (Stupid, I know). On my first suspension, I never had time to hand in my license and there wasn't any problems when it came time reinstate it. But someone was telling me that for the three month, it's a different story. I'm terrified that (because of what some friends have told me) my suspension hasn't actually started because I never handed in my license. (The suspension wasn't a result of high speeds or anything, it was simply a five over ticket that I couldn't get time off to fight if that helps at all)

Help on both of these issues would be very much appreciated.

Sometimes they make an honest error. Follow the instructions on the ticket to view the real photo (somewhere downtown if memory serves) and have them pull it up. Get to the bottom of it in regards to the plate number.

1. Like MX5 Miata Guy said, sometimes they make mistakes, however, that being the case, the ticket will not show up on your drivers abstract untill a finding of guilt has been received.

2. Althought you are suppose to turn in your licence when you get suspended, it rarely happens... when your suspension is up, follow the reinstatement contions to a tee... then double check to ensure it has been lifted... If you do not, next time you get pulled over, you will be treated as if your licence is still suspended, tow / ticket / headache...

Yeah, apparently they DO write tickets for five kilometers over the speed limit if you have adriving record like mine.


Which, in turn, gives you a three month suspension. :blink:
(When he said he was doing me a favor writing 5km/k over instead of 16km/h I should have clued in).

Yaeh dude, after three months? I bet that would be too much. License should be carried all the time you might never know when bad luck gets you. Wish you luck :mad:

It all worked out well, they just gave me a temp license slip and reinstated it (with almost $200 in fees) and I was on my merry way!
