SOoooooo. I got a ticket yesterday morning for 64 in a 50 zone. I was moving with about 5 other cars, but I got pulled over.. Surprise Surprise. I honestly thought the speed limit was 60, but whatever... irrelevant.
So besides me being pissed about a 14km/hr over the speed limit ticket, I drove down that road today, on 102st there IS NO SPEED LIMIT SIGN... from the traffic circle on 118th, right to 107ave.
I am aware that if not otherwise posted the speed limit on a residential street is 50km/hr.
My questions...
Do I have a leg to stand on in court? Has anyone fought a similar ticket?
I know 15 over is 2 demerits, How many is it for 14 over??

i'm in the understanding that up to 15km/h it's a 2 demerit ticket.
you deffiently could try and go in and say you were fallowing the flow of traffic and you feel because of being tuner car you were picked out, that yes you were going 64 in what you thought was a 60 zone and that you were in the wrong.

no signs and driving with the flow, if the judge or jp is feeling good that day you should be fine.
i have been in the same boat, where i did admit i was speeding but...with the efficient flow of traffic and he switched my ticket to one that was less money and no demerits.
my angle was i felt it was safer to drive with the traffic and keep my eye on the road and not my dash- he agreed. |

Speeding up to 15 km/h = 2 demerits
Speeding 16-30 km/h = 3 demerits
You can go the court house on or before your "plea" date (the one on the ticket) and ask to speak the early resloution CP. Explain your situtation, and see what they can offer (R/O charge maybe)... If they don't talk to you, or tell you to sod off, plead not guilty, get a trial date well into the future (try to make at least 6 months after the violation) ask the CP how to get full disclosure, this will give you access to the officers notes, This will help you prepare a case in the event it actually goes to trial.
On the trial date, you may get a differen CP, talk to him/her... and see if they are willing to deal, if not, take it to trial and let the crown prove their case... sometimes you can get lucky if you tell your side of the story to the judge.
If you were in the middle of traffic, and he was using radar, you will have a stronger case then if he was using laser |
