Can i fight a ticket in my dad's name? - Click HERE for Original Thread

rp_guy
As the title states, my dad owns my car (for registration and insurance) and i got a ticket, 69 in a 50 zone. It's $120, but that's money i don't have. Is it possible for myself to go to the court date and talk to the JP or try and fight it, or does it need to be my dad there?
Thanks

SilverNeonRacer
what kind was it, a photo radar? Or an actual they pulled you over ticket?

Ayeso
It would depend.. if its photo radar its going to be based on HIS registration ie, ticket goes to the owner of the vehicle / registration.

Pulled over would go to the owner of the DL in this case you.

goto the jp in a christian high school uniform works everytime

rp_guy
sorry, it was a photo radar, so it went to my dad

mot_bot
just curious, how the hell do you plan on fighting it? what is your arguement?

SilverNeonRacer
Just do what I did.. give your dad the cash :P

My Jag, which is registed under my dads name since it's our car that we are restoring together was photo'd going 20 over on Sask Drive a couple of sumers ago. I was driving so of course it's my responsibility to take care of it as far as my dad is concerned. The ticket was issued for his name.

I went down to the JP (dressed like a bum I admit) and asked for a reduction. Got it reduced to like $60 or something like that...almost half!

I was actually just going down to pay it, but I didn't know you could ask for reductions and I didn't want to fight it because...well Iw as guilty. But I got a reduction and it was a.o.k.

just wanted to update this thread:

i went down today (my court date was for this friday, so i went in 5 days early), albeit a little late for hours (they supposedly stop taking people in at 3:30PM and i end work at 3:30 so i got there at 3:50) and asked to speak to the JP. he saw me (and i wasn't dressed too well, t-shirt and jeans cause i wasn't expecting to talk to him), he asked me what i thought about the ticket, and i said i probably missed the sign.

i was very nervous  but he reduced it from $120 to $82. definitely worth the time to drop into the courts. it shouldn't take more than 30mins to talk to the JP, and even if they don't reduce it, you're there anyway to pay it so it never hurts to try. i think the biggest issue is just their mood; my buddy went in and they basically said FU. so dressing nicely in pressed clothes probably won't hurt for your appearance (but doesn't seem necessary).

good luck :fingersx:

Um. Isn't what you are doing against the law? Putting insurance in his name and driving it to save money. Wouldn't the ticket go to the driver? Must be a phone radar ticket then. If so, how are you going to fight a freaking photo radar ticket?

EDIT: Next time I will read rest of thread lol

He is listed as the occasional drive and occasionally drives the car but usually gets the ticket. Many people do that and i don't think its against the law. Who can prove how much he drives anyway

Exactly. And I can't see anyone in Alberta being rightous about "scamming" the Insurance system seeing as how we're all getting bent over as it stands.

nope. i'm not occasional; i'm the primary driver for my car (cause we got #cars=#drivers) so i'm saving money vs. if i owned my car (in registration) and went on my own policy.

my dad owns the title to my car, but it's still mine (i paid for it)

Hmmm. You can be the primary driver under someone else's policy?

I would go under your's if I were you. Insurance cost's are based on how many concecutive years you are insured under your own name.

Yes you can, I moved my wife's car to my policy and she is the primary on it.

as long as he is actually named on the policy it's helping his insurance rating.
