| 3 days ago i was on my way to a job interview heading up the ramp on yellowhead/156st then all the sudden i saw a manhole that was sticking out but around the edge it was cover by cement so that it would be safer while going over it. anyway the angle of the manhole seemed kinda big so i tried to move around it but i failed and i went over the manhole and it pop my low profile tire, so i was wondering if the city would pay for my tire, and how can i contact them because i dont know which number to call to talk to the city about this. |

Pothole Damage Claims
Each spring potholes appear on Edmonton streets. The frequency of dramatic freeze/thaw cycles, combined with more traffic and deteriorating infrastructure, create ideal conditions for the creation of potholes.
The City currently has 10 roadway maintenance crews dedicated full-time to pothole repair. Council decisions to undertake a road remediation program in 2007 and increased funding for snow removal in the 2007/2008 snow removal budget has decreased the number of potholes.
Claim History
In 2007, 1,033 pothole claims were presented to the City - of these 85% were denied.
The total payout for the year for all pothole claims was $103,040 with an average payout of $665.
The most common damage was to tires and struts.
Make a Pothole Claim
The Risk Management Section of the Law Branch investigates and settles all claims made against the City. To ensure claims are legitimate, claimants are required to submit a completed claim damage form.
Claims can be reported by calling the 24-hour hotline at 780-496-5130. However, the claim form must still be completed and submitted.
Statement of Damage or Injury Claim Form
Claim Evaluation
The City evaluates claims through a rigorous and fair process that ensures claims are legitimate and the City is actually responsible. Claims are paid only after going through the evaluation process, to ensure the City has properly assessed its level of responsibility for an incident.
Provincial law outlines the City’s responsibility and liabilities and sets a reasonableness standard with respect to the repair of roadways. City claims adjusters carefully review each pothole claim in context of the provincial legislation.
Provincial Liability Conditions
Claims must be reported within 30 days of the date of incident.
The City is liable only if it knew, or ought to have known, of the state of disrepair.
The City is not liable for damage caused by a system of inspection, or the manner in which the inspections were performed.
The City is not liable for damage caused by a system of maintenance, or the manner in which the maintenance is to be performed.
The City is not liable if it can prove it took reasonable steps to prevent the disrepair from happening.
The character of the road, and the area of the city in which it is located, are both factors that are to be used in establishing the reasonableness standard.
There is some accountability on drivers to watch where they are driving to avoid potholes as long as this can be done safely.
Key Points
Damages caused by potholes are not immediately paid by the City. Each damage or injury claim is evaluated according to provincial legislation to ensure the City is actually responsible.
The City is careful and fair when following its duties under provincial legislation.
Appeal a Denied Claim
Should a claim be denied the claimant can have the decision reviewed by a manager within the Risk Management Section. If the claim is still denied, the claimant can initiate an action in Provincial Court in an attempt to recover damages.

Who has reported a pothole recently?
I need one that has been reported and not fixed. My right entire front wheel is fucked thanks to this fucking city.
From what i read above they have so many loop holes out of paying its not even funny.
City roads are fucking pathetic. |

Not a pothole but similar...
I was driving east on yellowhead 2 weeks ago just past the casino and after passing the first intersection I hit something. The car shook and the cd player even stopped working for a few seconds.
Anyway, I turned around and went back to see what the hell it was. Our wonderful road construction crews didn't bother putting up any Construction or Uneven road signs and they just repaired a section of road maybe a 1.5 m wide and left it about 1.5 inches higher that the rest. I hit at 75Km/h.
Luckily no damage, but how irresponsible to:
1. Not put up any signs
2. Leave the road in that condition after "fixing" it. |

I see that all the time. My other personal favourite is giant rocks on the roads from the crews.
Im not paying a fucking cent for this wheel. I don't care how long it takes me. People need to waste the city's time like they waste our time and money. |

Yeah city's craters killed one rim on my Soarer that Egberts managed to fix
Just killed a rim on my civic too but it's just a hubcapped steelie so $44.07 later at walmart it's replaced.
It's a joke and they will do whatever they can not to pay. With my rim on the soarer they passed the blame to LaFarge who was sub'd to do the roadwork and laFarge said that their 50MM overlay.... yes 50mm was not capable of bending a rim.
They ignored me at that point and seeing as it only cost 113 dollars with egberts to repair i let it go.
You've got Volk GT-C's though if i recall so go hard. Don't pay a cent. |

GT-S. In a hard to get color and offset. Going to try get it too egberts today but I don't know if its fixable. I sure hope so.

Yeah what kind of damage do you have? Mine was thoroughly messed up, 3 inch long dent, 2 inch long dent, hub knocked crooked within the spokes but egberts managed to make it right again

| I did the same thing a couple of months back on that same manhole. Was following a transport in the morning and didn't have time to move after it appeared from under the 18 wheelers tires. Nailed my rim pretty good |

thats actually a good spot for dish rims. get a towel, fold it a couple times place it on the flat spot and wack it with a sledgehammer. i know its sounds hillbillish but if works depending on how much dish you got. |

Why should the city pay for your failure as a driver?
Instead of starting a thread asking how to get money from the city, you should start a thread asking for driving tips to avoid dangers on the road. That might be a bit more constructive. :dunno: |

The city FAILED to properly fix the damn road which is why he had to try and avoid the manhole cover. Go drive in Europe and see how many manhole covers stick 4 inches high. The powers that lead this city are clueless when it comes to road construction and design. |

| it was practically impossible to go around it since i noticed it the last minute. who would expect to see something that big on an exit. well the bump that took out my tire is being fixed up now its practically gone since the city is working on yellow head trail. |

what if you're following traffic and you notice within a second that there's a manhole protruding out of the ground (normally spans a good third of a lane)? you have mad traffic behind, beside and in front of you.
you can't swirve to avoid it otherwise you'll side swip the car beside you. You can't slam on the brakes otherwise you'll put the entire load on your front tires and do even more damage to your rim -plus, if you slam on the brakes, there's a pretty good chance that you'll cause a massive pile up.
sometimes these things are unavoidable.

how about this one...
driving on 82 ave off of 50 street heading east (by afi) i used to work by there..heading down the road and dodging all the raised manholes....and there was one sunken in a bit so i thought it was ok to drive over it..but to my surprise the pavement around the manhole was sunken in as well and i hit the manhole doing about 60km's an hour..rear view mirror went flying off into the back seat..the front control arm bolt as well as the subframe was pushed back about 2 inches..and it also cracked my transmision mount right in half..
now i think i should call the hot line lol |

And no, I do not tailgate, but trust me, I try not to be a hindrance to other drivers. I can't stand when people leave tons of room in front of them, especially at slow intersections. I've blown a tire before, but it was from swerving into the shoulder in an area with construction. I picked up a nail in my tire.
I could have blamed the guy next to me who slowly drifted into my lane...but instead, I just accepted that I could have braked and dropped back instead of swerving into the shoulder. Was the other guy a shitty driver. Yes. But could I have done something different to avoid the nail in my tire? Yes as well.
Defensive driving is about driving to compensate for other peoples' fuckups. |

| This whole fucking province is terrible for road conditions. You'd think the richest province in the country would have the nicest roads. Nope. I've been to almost every province in the country and Alberta is by far the worst. Even the repair jobs they do are horrible, they just patch the roads instead of tearing them apart and rebuilding. Try taking a note from BC, their roads are the nicest in the country, even the random backroads are smooth as silk. Harsh Alberta winters are not an excuse to leave the roads in such dismal shape. |
