Well last month I sold a minvan to a family. They told me they would pay with personal checks, 50% one month and 50% the next. It was only $4000 total so I decided to help this family out.
This month the check bounced back due to the bank acount being "close".
I talked to the guy and he told me that his mother died so there wasn't any money in the bank. He say he'll give me money this week. So this week comes by and no phone calls back, cell phone off, no emails.
So should I put a lien on the van? How do I do this? Should I report to the police? Should I wait another week?
Edmonton used to be so nice when I was a kid, now poeple just want to fuck nice people over. F!@#k like I was just trying to HELP them out...... |

Unfortunately you're probably screwed.
The best thing I can think of is to draft up an letter of agreement for a payment plan & calmly tell him that you have been "advised" to offer him a reasonable repayment plan using traceable forms of payment & if he doesn't agree or fails to make the payments you'll pursue more formal legal options.
Basically you can try to get yourself a leg to stand on. It would also help to bring the most official looking guy you know along with you when you meet him (which can also be a witness). Preferably meet him at his work (where he won't want to create a scene) & don't let it degrade into a bickering match. If he pretends he doesn't have time set a time & if he avoids you, continue going to his work. |

I don't think payment plan is going to work. I'd want to check with the police about a repo action. If the guy didn't pay this time, and is already getting into dead relative excuses, you can be pretty sure he's a deadbeat. It's not like you can go shopping anywhere else in town,pass a bad check, THEN negotiate a payment plan.
Unless money magically appears, this is theft. |

Although true, it doesn't appear as if there is any way of coming out the winner if police/lawyers get involved. Unfortuately he can just say he paid him in cash when it was sold & there is nothing to dispute that. At least if there is an agreement of some sort in place that he fails to follow, then there is something to go on. As much as it would be nice to see this guy charged, it isn't a real possibility. The best that can be hoped for is to reclaim the money/van. |

He's got a bounced personal check for half the amount, another check post dated for the other half (well i HOPE he does), a bill of sale, previous proof of ownership, names, bank info, stuff like that. It's at least something to work.
I don't think this will be easy, and I sure think it's better to get the van back than to work for charges, but if the van or money don't show up, and it doesn't look like either will, legal recourse is the only thing left. Time consuming, money loosing maybe, but a lot better for a lot of reasons than donating a van to the asshole fund.

3. bills of sale, payment terms are 50%/50% using personal checks
4. My own proof of ownership
5. Bank infor on his check
6. Address, about 5 mins outside of edmonton.
He told me he just started working at fort Mac, is that reasonable that he won't answer my phone cuz he is working? What are the work shifts like? 3 weeks on and 3 weeks off?
I trust him because they had 2 babies and one more coming and it seemed like they really could use a van.
so can I put a lien on the van, just in case they are trying to sell it? |

Call the police and get your property back. End of story. You sound like a nice guy but your getting completely taken advantage of in this situation. For all you know by this point the van could be damaged, or gone all together to support someones drug habbit. Its not your problem that he has a bunch of kids or that his mom died.. Its your problem that someone has taken your van and not given you anything.
P.S. I don't feel like driving my car all the way out to nisku every day because I am putting a lot of miles on it. Is it cool I borrow your 350 and use that instead ? I really need tires and I have a girlfriend and 3 cats to fee at home and my car costs a lot on gas. |

Bro. It seems like you are a trusting guy, but the guy stole from you. He stole your car. He is trying to scam you. Call the police and report it stolen. Did both cheques bounce? If his Mother died why didnt he return the Van? Go to his house and get your Van back.

| If he worked in Fort Mac, he'd have enough to pay you. Where I work, it's typically "10 and 4" (10 days there, 4 days back) or "20 and 8". They were throwing around the idea of "15 and 6" as well. |

Anyways, I spoke with his sister and he is going to back in edmonton tommorow so I'm going see if any money is coming my way or not.

| Seriously though, seems like you have your ass covered, you wrote the terms of the sale on the bill of sale when you sold it... He did not live up to the terms of the sale... Therefore the contract is void and you deserve your property back... That is, providing he doesn't come up with the other 50% of the money... |
