I remember hearing a long time ago that it is illegal to sell an unsafe vehicle?

For example - brakes do not work on the car and you told the buyer that everything on the car is like new.

Any truth to this?

What recourse does the buyer have if it is true? Can the seller be liable for personal injury caused by the faulty brakes?

I believe the buyer would have to prove that you knew the vehicle was not roadworthy.

And even then, this is covered by the "as is where is" clause that everyone puts in their bills of sale.

lol... if "i" knew the vehicle was not roadworthy? i wouldn't rip off someone like that. i'm just the one asking the question.

this guy i know who is a lawyer says that where he practices it doesn't matter if the seller is aware of the flaw in the car or not... the seller is still responsible to the buyer. just wondering how things work here in alberta.

from what i remember way back when i heard about selling an unsafe vehicle that even though there is the "as is" clause it does not cover unsafe vehicles.

I talked to my dad, who is an appraiser/adjustor and has taken a lot of courses on these kind of things. He said it is the buyers responsibility to have the car checked out before purchase.

If a person is smart, they will get a mechanical inspection on a used car whether there's new parts or not. The only exception would be at a dealership cause they safety those already. But yeah, private used car buys should always have an inspection run on them whether it's by the owner or you.

I would like to add that even if the vehicle is from a dealer, Take it to another shop for the inspection. Depending on what the cost of the vehicle is, the boxes on the forms are a bit in the grey area.

I bought a car from TEAM FORD a few years back. I was told the engine was rebuilt by them....I thought great. They did the inspection...of course it passed with flying colors. After purchasing the car, I actually started checking the part numbers of the pieces they put into the car. The car I bought only came with a H.O. v6...They rebuilt the engine with components...including camshaft from the normal V6 found in other cars....never was available on the car I bought. There was only a 15hp or 20 hp difference. In the end I felt I overpaid for the car and TEAM FORD told me to get lost.

From that time on, I NEVER trust the word of a Used Vehicle Manager or Salesman (even from a so-called reputable dealership). Take the vehicle for an inspection elsewhere. They want to sell you the car first...Period!!!
