Heres a question that I have wonderd about, but not sure of.
Say you pull up to an intersection (not a 4 way) and you are turning left and you are at a stop sign. Another car is across from you at a stop sign going straight across. Who has the right of way?? The vehicle that comes to the stop first, or the car that is going straight across the intersection?????

The car going straight has the right of way,i don't remember the logic of it though.

How about use the common courtesy rule, let them go first and then there is no possiblity of an accident. I would think that person going straight should have right of way though.

I believe the phrase that the insurance companies like to use is "last chance to avoid" - they are the one at fault.

So technically if the guy clipped your rear bumper at a 4 way while you were turning left, then he had the last chance to avoid and it's his fault.

However, it is not clear cut - because if there are no witnesses it is your word vs. the other guys (And the police won't come out since no one will be hurt). Without witnesses, I would imagine you'd be looking at a 50-50 for a small part of the cases - but again it depends on your adjustor as some will roll over and take it up the ass before spending 1 minute defending you.

So the answer is - typically the one turning left is at fault. However, if the guy coming through didn't stop, you have witnesses, etc,etc... You have a better chance of being not at fault.

My understanding was that a 4-way stop is FIFO - first in first out. If you both get there at the exact same time i'd yield to the guy going straight but otherwise I think you have the right of way.

GSR he said its not a 4 way stop. And yeah Straight through comes before turning. What always get me with that situation is sometimes the guy going straight doesent go which is a pain in the ass... people need to learn the damn rules.

Thats my exact point.....I always go by the rule the peron going straight thru has the right of way, but people going straight just sit there....so when you do decide to go their honking and crap at you. But I wanted to make sure I was doing that right.

It's last chance to avoid - which isn't always the person turning.

Of course you use courtesy when dealing with it - letting the FIFO rule come into play. But once you get into the accident, it isn't going to matter "who's turn it is".
