Jim,

Could you clarify to me what you would/could get a ticket for in this case? I just want to be sure, because I cannot afford to get a $575 ticket. period.

I just wanna know: if once you have stopped for them, and they clear your side of traffic... can u then proceed? Or do you have to wait until they cross all the way to the other side of the crosswalk? It wouldn't make much sense to have to do that, but i still wanna be sure. Thanks :)

I believe this is what the law states.

I'm not Jim but I remember hearing about this specific question a while back.

Id like to know the answer to those questions as well. I think pedestrians get right of way no matter what, they can jump out on your car, and you will get sued. :blink:

Yeah IMO people how stop for pedestrians should have to put on there hazards or something. Too many times have a seen cars in the left hand lane blow by a one or two other cars that are stopped for a pedestrian. Maybe putting on hazards would help this situation? Maybe I'm a retard? Just something I thought up when I was on the road...

Oh shit, thats the scariest situation, when the car in the other lane has slowed down or stopped, most likely to turn but too often there will be a pedestrian crossing. I always slow down, when that happens.

I think you have to wait until they are on the sidewalk..

This whole pedestrian thing is retarded, how about educating the pedestrians not to jump out in front of a moving vehicle?

I dont know how many times ive had to lock up all 4, come to a screeching halt because some asshole supermans in front of my car.. with my luck i'd get a stunting ticket at the same time :) what a super way to piss away nearly 1k... this hasnt happened yet, but the way things are going i dont see it not happening.

Some laws are just protecting people from themselves.. are we gunna start making people buy plastic knives cuz metal ones can kill? :) please note: the last sentence is comic relief. Flamers will be poo'd on :P

Okay folks here's what the "Traffic Safety Act - Use of Hwy & Rules of Road Regs" has to say about the issue.

Yielding to pedestrians:
41-1 A person driving a vehicle shall yield the right of way to a pedestrian crossing the roadway within a crosswalk.

41-2 Where a vehicle is stopped at a crosswalk to permit a pedestrian to cross the roadway, a person driving any other vehicle that is approaching the stopped vehicle from the rear shall not overtake and pass the stopped vehicle.

41-3 At any place on a roadway other than at a crosswalk, a person driving a vehicle has the right of way over pedestrians unless otherwise directed by a peace officer or a traffic control device.

41-4 Nothing in subsection (3) relieves a person driving a vehicle from the duty of exercising due care for the safety of pedestrians.

I can't see anywhere that specifically states you have to wait until the person is entirely across the road before you continue on; however, it should only be done when safe.

I see it everyday at work (NAIT) - I'm trying to cross the street, the crosswalk lights are flashing and every car is still going through the lights.

The only way I can cross is if I just step out one step to get them to stop. My plan next time is to haul an old computer across, and just let the cars hit it first instead of me. That'll f@cking teach them.

Sorry - but most drivers couldn't give two shits about the pedestrian, and figure the pedestrian has to wait until it's clear.

Bullfuckingshit. If it's a marked crosswalk you best be stopping.

How to they expect a car that is doing the speed limit (50-60km) to stop in 10-20ft? without having their ass smashed into.. :)

a little education (on both sides) goes a long way...

I suppose this is probably a rumour, but I heard that recently a law was made to try and prevent j-walking, where if your in a car, and you stop traffic to let some one J-walk you would get a ticket, becase they could proceed and someone else could smote them from the planet.


My guess is that this is BS, but I figured, if there was ever a time or a place to ask, it would be here and now.

Ok so what Jimbo was saying is, that you can enter the crosswalk with your vehicle is the pedestrian is still in it....as long as its safe???? Was I reading that correctly?

my understanding was you can get a ticket for that.....so the ticket is for not yeilding to a pedestrian crossing at a controlled crosswalk??

That's my interpretation.

However, talk to Blaine - I believe his receptionist got a ticket for this like the first week they came out....

Pedestian killed on Whyte and 106th last night, one car stopped the other car however didnt. People were yelling at the pedestrian to stop but couldnt hear them as he was wearing headphones.

Some one on Ched said that you can get a fine if you turn right at a set of lights even if they pedestrian is way over on the left hand side walking.

From the 41-1, it does sound like you couldn't go throught a crosswalk until the pedestrian is clear of the cross walk.

albertaRC that must be incomplete, where's the part regarding the person crossing and the equal fine for them if they step off the white lines. I definately remember reading that.

From what I read and understiid previously you must wait until the person has completely crossed the street before proceeding, also if they step outside of the white lines they are subkect to the same fine as if you run the crosswalk.

TrevorK, i think you need to spend a few weeks in Montreal. Then you'll relly know what it's like when drivers don't care about pedestrians, compared to there we have it good here.

In montreal, if you jay walk, they will speed up and make you run

Funny story. I used to live in Ottawa. People, me included, would cross against the light when safe to do so. My first week here in Etown was the weirdest thing. I'm downtown, no cars in sight, people to the left of me, people to the right of me, behind and in front, all stopped at the Amber Hand. I was about to go but thought I'd better not when NOBODY else was walking. In Ottawa/Montreal, the whole crowd would have went.

Funny how this brilliant Alberta government spends years on the Traffic Safety Act and the Regulations with next to no consultation with the actual public that has to live with the consequences of some truly stupid provisions, drops the thing like a bombshell with much of the usual PR hoopla, then disappears when the rest of us have to live with the mess they created. How PC (electrical deregulation, gas prices, etc. etc.). Anyway, folks, section 94 of the Rules of the Road Regulation says that a pedestrian MAY indicate an intention to cross at a crosswalk by raising his arm and pointing in the direction he intends to cross, whereupon drivers SHALL stop before the crosswalk and allow the pedestrian to cross. Seen any public education on this simple little provision which should make life easier for drivers and pedestrians? Of course not. This is Alberta, afterall. If you guys haven't already done so, please bookmark the Regulation and read the thing like a Bible. Those of us that are on here are probably perceived by our friends as "car people" and we should take the time to educate ourselves so we can speak intelligently to the less informed. That's a really good idea! IMO

Anyways, i'm still unclear as to whether or not you can proceed before the pedestrian crosses the whole crossing. I was after Jim posted, but then there's all these people disputing it :wtf:
