Well, first the story:
Last night my brother went to pick up his g/f to go see a movie. We went into the house while his car was left running on the street out front. She was taking too long so he told her that he would be waiting in the car because he wanted to listen to some music.
So he goes and sits in the car to wait. While he is waiting, a cop car drives by and then makes a u-turn and pulls behind him. My brother lowers the window and the cop asks what he is doing there. He tells him and then the cop asked for his license/reg/ins. My brother hands them over and then waits. His g/f comes out before the cop comes back to the car so now they are both waiting. Cop comes back to my brother with 3 tickets! One for window tint (my brother said he can live with that because he knows it is illegal) and then one for not wearing his seatbelt and one for excessive noise from his exhaust. :blink:
Now he was mad about the seatbelt one because he always wears a belt but just hadn't put it on yet because he just got in the car. But the exhaust one pisses him off the most. He drives a 2001 Hyndai Accent with just a bolt on Ractive muffer. The thing isn't overly loud and when he is idling like he was it makes like no noise what-so-ever.
So bottom line it, the exhaust one is the main one he is pissed off about and would like to try to fight. Now I remember reading at one time that the officer has to actually measure the db of the exhaust to be able to give the ticket. Is that right? And what does the law actually say about loud exhausts?

i could be completely wrong on this one about the seat belt ticket...but i heard some where that the vehicle that you are in must be going faster than a certain speed.......
can some one look that up.... |

Yeah that sounds like a fair bit of BS, and I don't understand how you could get an excessive noise ticket if your just idling....unless you were sitting there reving the engine?
The seatbelt, he must have noticed your park brake on and what not...you know, the fact that you werern't moving
Tint...eep, thats all i have to say and what percentage is your brothers front tint?
I agree with above, fight 2 of three, least then your left only with a tint ticket. |

yeah, the ticket for the exhaust is probably correct. I got one also. The cop said because the tip has been enlarged..yadda yadda yadda....don't think you'll get that one off.
only one that you MAY get off is the seatbelt. |

His ticket was for being too loud he said - has nothing to do with the size of the tip. |

According to my brother, the ticket says "excessive noise". Nothing to do with enlarged tip. He has one of those mufflers with the dual dtm tips (turned up). I don't think they would be considered enlarged because they are only 2" each.
Anyway, what I am still curious about it how they determine that there is excessive noise coming from the muffler? Do they have to measure it? He wasn't asked to rev up the engine or anything, and trust me, at idle, you can barely hear his car.
What bugs me about that is that I almost never see these noisy ass pickups or harleys being pulled over... :wtf:
Anyway, his wasn't as bad as when I had my car siezed 2 months ago for being 1 day late with my registration. I even had it in the car and offered to drive with the cop to the registry to pay it, but no. Expensize ticket and a siezure for me. :thumbsdown: And since then I have talked to several people that have been stoped months after and not gotten a ticket. One guy at work, his wife got pulled over and her registration was 10 months expired and the officer just laughed and told her she better get it renewed.... |

| I do totally agree with you guys though....cops should try working with us instead of slammin' us down everytime. You think these make us realize "oh, we better change our exhaust" ...hell no. You just get more pissed. Oh well though, honestly, what can we do? |

The cop should have cut that poor guy a break. He drives a Hyundai Accent, life is already hard on him.
P.S. the seatbelt ticket is questionable. Once at a gas station I saw a cop come up to a girl in a red truck with tinted windows including the driver side, but when she rolled down the window, she was a looker.. big air bags and tons of make-up. He appeared to relax right away and leaned on her window to chat. No ticket issued for not wearing a seatbelt while the engine was running. Just a friendly chat and a wave good-bye. :puke: |

There is no law about having to wear your seatbelt when the vehicle is running....that is total BS. And for the speed law to be exempt from wearing your belt that applies to delivery drivers only if they drive under a certain speed limit (cant remember exactly the speed)
But heres a point. Police officers cannot break the law to enforce the law. So when he was giving you the sealt belt ticket he went back to his car and sat in it. I bet he didnt shut his car off either. And I bet you anything when he sat in his running car to give you a seatbelt ticket do you think he pulled his seatbelt back on.......I doubt it. So now he was breaking the law as well. I know this dosen;t work cause all you will do is have a pissed off cop following you all day but put in a complaint that he wasn't wearing his either. |

and Deathby240 , what about new 350Z 2.5 inches + 2.5 inches = 5 total,
and on 300zx i think its 1.5 x 2 on each side, for hte stock ones anyways. that equals 6.
And i didn;t think there was a specific size.

But I am doubting the inlet to the muffler on the Accent is 3''. I should go back and check out what the actual law is, but I am lazy, so I will shut up. |

He was on the street though. Old neighborhood and no driveways or anything. He was just sitting on the street.
And deathby240, and never said his ticket was for enlarged exhaust anyway, it specifically says "excessive noise". I would assume that to be two different things. And on that excessive noise thing, on 3 occasions this weekend I was behind 1 or 2 harleys and the guys were either making tons of noise while accelerating, or even revving the motor while cruising at a constant speed. How damn annoying. With my stereo cranked, I could still hear the noise way over. :wtf: I hope they get lots of tickets... :rolleyes:
BTW, my brother is going to fight both the seatbelt and the exhaust ticket. I will post what happens. :) He said the officer told him to "go ahead and fight it" so he will. |

you can do what ever you want on your drive way unless its after 11 at night or in going to indanger someone. They can't do anything to your car if its on your drive way. Someone could report you for noise pollution I guess. |

right and wrong.....police officers have to obey traffic laws just like anyother person.....however they are exempt in certain circumstances when they are working. ie. when they transport prisoners they don't have to wear their seat belts due to officer safety.
