OK, I finally get to rant after being pulled over 5 times this year with no tickets. I was out late last night and an idiot wanted to race me down 50th street. I left the intersection fast (i admit!!) but he was going well past me and I let off at around 70 or 75 kph in a 60 zone. I was the one pulled over and after 20 min of letting me sweat it, the cop comes back and tells me he clocked me from driving behind and wrote on the ticket:

zone: 60
speed: 100+ kph!! (no actual speed recorded)

I questioned him on the speed asking what his radar said and he answered:

"are those windows tinted.........and your muffler is oversized- that's what makes the car so loud...those are two other fines I am not giving you"

My question to law enforcement on the forum (I know you guys have been helpful to others in the past):

Why was there no exact speed on the ticket, and can you write a ticket saying xxx+ kph?

Can you get a reading from a radar gun in a moving cruiser following another car? (I thought you couldn't....but the speed was marked as "clocked" and not "estimate")

Is there anything I can do about this or is the best advice just to pay the fine?

fight it go to court and ask the cop in front of the judge you might get it thrown out.

Yah, he wrote in a fine of $177! I just wasn't aware that they could write 100+ (ie: and estimate) on a ticket and come up with a specific fine. I think it is bogus, but wanted to check with everyone. I just don't want the demerits either!!

If you think abbout if he is driving behind you, all he as to do is add his speed, to the radar speed of your car, and that would give him your actual speed. Same goes for when a cop is coming towards you, he just subtracts his own speed from the radar reading.

I dont know how radar guns work at all, im just assuming. Not sure if a cop is allowed to do that or not either.

if this was in edmonton which I assume it was.....EPS does not have "radar" in their cars.......ALL EPS cruisers have CALIBRATED speedometers and all they have to do is back theis ticket accordingly...ie. following distance, speed, car calibration number etc.

as a side note Jordan......you are wrong about the radar theory. The radars do that by themselves. They have different modes on the radar such as stationary or moving so the radar compensates if you are moving. JUST FYI not flaming or ranting!!

Thanks for the info......my question though is:

can they give me a bogus ticket for 100+ like they did when I was definately NOT going 100+. Don't they have to put the actual speed they are ticketing me for like 95 or 110 or something (the number is irrelevant, just thought there should be one)? I just want to put this out on the forum to see if I would have a shot fighting this one. Let me know guys....

With the new TSA (Traffic Safety Act) I am not sure about certain speeds....the may have changed it so that if you are over "x" kms all they have to do it write what you had. Use the search and find the posts from albertarc where he gives the links for the TSA.

I have put down xxx+ for a speed when I reduce a fine to give a person a break. Eg - Posted Speed: 100, Recorded Speed: 115+ (when the actual speed may have been 120 etc). Then I make note of the exact target speed on the back of the ticket. I have slowly started to go away from this though as it seems there are more people whom I give breaks to that seem to want to plead "Not Guilty" or would like an even more reduced fine. I am now writing more of the exact speeds & if someone wants to ask for a reduction they can attend Court - onus is on them.

As far as Radar, here is a link to one of the newer manufacturers out on the market. Take a look at all of the different models / features ... ooooh, ahhhh, ohhhh.

I would recommend fighting the ticket, it's helpful... however I think if he recorded a speed off 115km/h and you don't get it reduced you ahve the risk of having the a ticket issued ofr the original speed not his generous reductionl.....

$177 ticket sounds like 30km/h over and 3 demerits, like the one I got.... :)

Consult your local lawyer, "tickets " on 100st/104 ave

I see this big conflict between Jimbo helping us out by advising what is legal or not, then all of us continually saying " I am going to fight the ticket."

Jimbo doesnt seem to like when we talk about going to court to reduce tickets, it costs his department time and money. I hope he realizes that too many tickets are seen as cash cows, and are not impoving road saftey.

Any thoughts?

I have an idea Don't RACE or speed or run red light etc.....then you would have nothing to bitch about. He should go to court appoogize to the judge and police officer and PAY the WHOLE damn ticket and consider him self lucky that he didn't get a racing ticket.....how about that?? :thumbsdown: People should start taking responsibilities for their actions!!!!! that is part of the PRIVILEGE to be driving.

OK now.....the whole point of this post was to get some ideas from others who may have had the same thing happen. Yah, i admit that I launched my car and got up to 70-75 in a hurry....but I let off (in second gear) and was slowing when he turned on the lights. My concern was that he didn't actually clock me at all because he commented on my exhaust (loud) and mentioned it sounded really fast. SOOOOO......I expected a speeding ticket for 15 over (20 over at the most), but definately not this. I am not complaining about the ticket....I am complaining about the innaccuracy of the fine! I am responsible and this is the first ticket I have had in 7 years!

Whatever though.....it is all irrelevant cause Jimbo answered all my questions and you won't hear me on this issue again.

Same thing happened to me when I was 18 years old in my 90 Teg. Cop saw me go by on 97 st when he was parked in the old Northtown mall parkade. Granted it was 5am and I WAS flying but I was 3 blocks away when I saw his lights turn onto 97st behind me.
He didn't get me on radar but said he clocked me with his speedo from 3 blocks back and had estimated my speed at 125 in a 60 zone when he first saw me. Needless to say I was going fast enough that it was a court appearance + $300 fine + 6 demerits. I fought it in court with my POINTS lawyer and got off with a $200 payment to my lawyer, no demerits, and no fines. You definitely learn things as you get older...that one scared me straight. But yes I have had 2 tickets over the years from cops who were in traffic behind other cars behind me. They clock you against their CALIBRATED speedo and write you up. Good luck with the fight.
They seem to pick you even though everyone else, including the cop, is going the same speed. Looking fast isn't always the best......long live the sleeper. :wtf:

Duane if you say 70-75 and the cop says 100+, somebody's lying. I would be thankful for the one ticket, but I don't appreciate somebody lying to me either, telling I did something I didn't.
